SwagCityTerms of Use

These Terms of Use govern your access to and use of the SwagCity mobile application and related services provided by Zorbit. By using SwagCity, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your region) and able to form a binding contract to use SwagCity. If you use the app on behalf of an organization, you represent that you have authority to bind that organization.
2. The Service
SwagCity lets you upload photos, choose styles, and generate AI-transformed images (“swags”). Features, styles, pricing, and credit costs may change. We may modify, suspend, or discontinue parts of the service with reasonable notice when practicable.
3. Accounts
You are responsible for activity under your account and for keeping sign-in credentials secure. Provide accurate information. You may delete your account anytime in Settings → Delete Account. We may suspend or terminate accounts that violate these Terms or pose security or abuse risks.
4. Credits, Purchases & Subscriptions
Some features require credits or a subscription. Purchases are processed by Apple (and may involve RevenueCat). Credits have no cash value and are non-transferable except where required by law. Subscriptions renew according to Apple’s terms unless canceled. Refunds are handled under Apple’s policies and applicable law. Failed generations may be refunded as credits at our discretion. A Pro subscription grants a weekly credit allowance for as long as the subscription is active, including on annual plans, which are billed yearly but credited weekly. Deleting your SwagCity account forfeits any remaining credit balance without refund and does not automatically cancel an Apple subscription.
5. Your Content
You retain rights to photos you upload. You grant us a limited license to host, process, and display that content as needed to provide SwagCity (including sending it to AI providers). You represent that you own or have permission to use uploaded images and that they do not infringe others’ rights or contain illegal material.
6. Generated Swags
Subject to these Terms and third-party provider policies, you may use generated swags for personal, non-commercial purposes. Commercial use may require additional rights. AI outputs can be imperfect or unexpected; you are responsible for how you use them. We do not guarantee uniqueness or fitness for a particular purpose.
7. Acceptable Use
You agree not to: upload unlawful, abusive, or infringing content; attempt to reverse engineer or abuse the service; interfere with other users or our systems; use automated scraping beyond normal app use; or generate content that violates law or Apple’s App Store guidelines. We may remove content or restrict access for violations.
8. Intellectual Property
SwagCity, its branding, UI, and software are owned by Zorbit or its licensors. These Terms do not transfer ownership of our IP to you. Style catalogs and prompts remain our property or that of our partners.
9. Disclaimers
SwagCity is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. AI generation depends on third-party services that may be unavailable or change without notice.
10. Limitation of Liability
To the fullest extent permitted by law, Zorbit and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, credits, or profits arising from your use of SwagCity. Our total liability for any claim relating to the service is limited to the greater of amounts you paid us for SwagCity in the 12 months before the claim or AUD $50.
11. Termination
You may stop using SwagCity or delete your account at any time in Settings. We may suspend or end access if you breach these Terms. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.
12. Changes
We may update these Terms. Material changes will be reflected by updating the “Last updated” date. Continued use after changes constitutes acceptance. If you disagree, stop using the app.
